We are seeking archival photos, videos, and memorabilia to help visually tell the story of coming of age in Chico before the digital era. Your contributions will help bring authenticity and life to the documentary.

All submissions must have a completed release (below);

Participation, Release, Limited Liability in The Horror We Make *

I hereby acknowledge that I am submitting archival and/or media for consideration in a motion picture named [Title Noted in Form] being produced by Koa Aloha Media, (hereafter, Producer).

GRANT OF RIGHTS

I, the undersigned (“Contributor”), hereby grant to B. Luciano Barsuglia and Koa Aloha Media (“Producer”) the non-exclusive, perpetual, irrevocable, worldwide right to:

Use, reproduce, edit, modify, display, and distribute the submitted materials (the “Materials”); Incorporate the Materials into the documentary project currently titled Growing Up Chico (the “Project”);
Use the Materials in connection with promotion, marketing, distribution, and exhibition of the Project in all media formats now known or later developed,

This includes, but is not limited to: film festivals, theatrical exhibition, streaming platforms, television, physical media, websites, and social media.

OWNERSHIP & AUTHORITY

I represent and warrant that:

I am the legal owner of the Materials or have obtained all necessary permissions to grant the rights described above
The Materials do not infringe upon the rights of any third party; Any recognizable individuals appearing in the Materials have granted permission for their likeness to be used; or the Materials were captured in a public setting where no reasonable expectation of privacy existed.

LIKENESS & SUBJECT USE

To the extent that any person’s name, image, voice, or likeness appears in the Materials, I grant (or confirm I have obtained) permission for the Producer to use such likenesses as part of the Project and related promotional materials.

I understand that the Producer may rely on:

Contributor-provided permissions
The documentary, editorial, and historical nature of the Project.

FAIR USE ACKNOWLEDGMENT

I understand that the Project may incorporate Materials under principles of fair use, including but not limited to commentary, criticism, historical reference, or transformative use.

Nothing in this agreement limits the Producer’s right to independently determine whether additional materials (including portions of the Materials submitted) may be used under applicable fair use doctrines.

NO COMPENSATION

I understand that:

My contribution is voluntary; I will not receive financial compensation now or in the future; Proper credit may be given where feasible, but is not guaranteed.

RELEASE & WAIVER

I release and discharge the Producer and Koa Aloha Media from any and all claims, demands, or liabilities arising out of or in connection with the use of the Materials, including but not limited to: Copyright claims; Right of publicity or privacy claims;
Defamation or misrepresentation claims.

I have read, understood and acknowledge the terms of participation, the release, and limited liability as noted above.
